• the German Regulations on Lawyer Specialization (Fachanwaltsordnung or FAO),
• the German Act on the Remuneration of Attorneys (Rechtsanwaltsvergütungsgesetz or RVG) and
• the Professional Rules for Attorneys in the European Union (Berufsregeln der Rechtsan­wälte der Europäischen Union or CCBE).

The representation of conflicting interests is prohibited for attorneys according to the German Federal Lawyers’ Act (§ 43a para. 4 BRAO). Before accepting a mandate, conflicting interests are always checked.

Out-of-Court Dispute Settlement

In case of disputes between attorneys and their clients there is the option to file for extrajudicial dispute resolution with the regional Chamber of Lawyers (cf. § 73 para. 2 no. 3 in connection with §73 para. 5 BRAO). In addition, the German Federal Bar Association established an independent body

to resolve disputes between members of the bar association and their clients in accordance with §191f BRAO. The body is named Conciliation Board of the Bar (Schlichtungsstelle der Rechtsanwaltschaft).

The insurance coverage does not extend to liability claims arising from work performed through law firms or offices established or maintained in other countries; in connection with advice in or work relating to non-European law; and by the attorneys in front of non-European courts.
